OFFER AGREEMENT
This contract is a public offer of the Seller, which is addressed to public in general, a contract for the sale of goods remotely with the Seller on the terms speficied herein, including all Appendices (hereinafter - the Contract).
1. Definition of terms
1.1. Online shop - an Internet website located at the website address http:// Gepard-Hunter.com, where the Seller is a sole proprietor Dykhta Oleksandr Yuriyovych offers goods for sale to buyers in accordance with the terms of the Agreement.
1.2. The website is http://Gepard-Hunter.com
1.3. The seller is a sole proprietor Dykhta Oleksandr Yuriyovych and her goods are offered and available for purchase by Buyers through the website.
1.4. Buyer - any natural person who orders Goods through the website for their personal needs.
1.5. Product - any product offered by the Seller for ordering through the website and which can be purchased by the Buyer.
1.6. Order - a duly formed request of the Buyer for the purchase and delivery of the Goods offered on the website.
1.7. Shopping Bag– an electronic cart containing the Goods selected by the Buyer, for which the Order has not yet been placed and for which money has not yet been paid.
2. General provisions
2.1. By registering through the Online Shop or placing an Order (purchase of Goods), the Buyer confirms that:
• He/she has reached the age of 18, and has full legal capacity and will purchase the Product exclusively for personal non-commercial use (consumption);
• He/she is familiar with and agrees to all the conditions set forth in the Agreement and on the Online Shop’s website;
• He/she agrees to the transfer of his personal data, its processing, storage, transfer and use under the conditions defined by the Agreement and certifies the receipt of information about the owner of personal data, the composition and content of the collected personal data, his/her rights according to the law, the purpose of collecting personal data and the persons to whom his/her personal data is transferred. Personal data provided by the Buyer to the Seller is stored for 3 years from the moment of the last purchase by the Seller on the website. The Buyer's personal data shall not be disclosed to third parties, except for the cases stipulated by the current legislation of Ukraine.
2.2. The Seller has the right to make changes to the Agreement without notifying the Buyer, therefore it is recommended to regularly check the validity of the terms of the Agreement, since at the time of using the website or placing an order, the conditions, valid at that time, apply.
2.3. The term of validity of the Agreement is not limited, unless otherwise stated on the Online Shop’s Website.
2.4. The Seller provides the Buyer with complete and reliable information about the Product, including information about the main consumer characteristics of the Product, the place of manufacture, as well as information about the warranty period and expiration date of the Product on the Online Shop’s website.
3. The price of the product
3.1. The name, quantity, selection, article number, and price of the Product selected by the Buyer are indicated in the Shopping Bag at the Online Shop Website.
3.2. The Seller has the right to unilaterally change the price of any item of the Product.
3.3. In the event of a price change for the ordered Product, the Seller undertakes to inform the Buyer about the change in the price of the Product within 3 (three) working days.
3.4. The Seller cannot change the price of the Goods paid by the Buyer.
3.5. The Buyer's obligations to pay for the Goods are considered fulfilled from the moment of receipt of funds to the Seller's account.
3.6. The order, the terms of which were made on the website with an error, in particular, if an error was made in the price of the Product, is not considered to be executed and does not create obligations for the Seller and the Buyer regarding the purchase and sale of the Product, unless both parties agree otherwise. In this case, the Seller can cancel the Buyer's order and return the money paid for the Product (if it was already paid by the Buyer) or offer the Buyer to pay the correct amount of the cost of the Goods.
3.7. Settlements between the Seller and the Buyer for the Goods are made by the methods specified on the Online Shop Website.
4. Placement of the Order
4.1. The buyer can order the goods using the services offered at Online Shop’s website - http:// Gepard-Hunter.com.
4.2. To register on the website, the Buyer has to provide the following information:
• first name and last name;
• e-mail address (E-mail);
• create a login and a password.
After successful registration on the website, the Buyer receives confirmation of registration to e-mail specified during registration.
4.3. To purchase the Product (including without prior registration), the Buyer has to provide the following information:
• Last name, first name and middle name/Father’s name (of applicable);
• phone number;
• country of delivery;
• city of delivery;
• e-mail address (E-mail);
• adress of delivery;
• payment method.
4.4. In the event of a refund for the Goods, the Buyer must provide the Seller the following data or documents:
• passport details and/or registration number of the taxpayer's account number ("identification code");
• details of a bank account, to which the refund must be deposited;
• other information and documents that are necessary for the refund to the Buyer.
4.5. The quantity and value of the created Order is displayed in the Shopping Bag before the Buyer completes the Order.
4.6. After placing the Order, the Buyer may send a confirmation with the order number to the e-mail and/or SMS message to the Buyer's phone number. Confirmation of the Order can be carried out in another way, determined by the Seller.
4.7. If the Seller needs additional information to fulfill the Order, he/she has the right to request it from the Buyer. If the Buyer does not provide the necessary information, the Seller has the right to cancel the Order and is not responsible for the Goods selected by the Buyer.
4.8. By registering on the website and/or purchasing the Product, the Buyer agrees to the terms of this Agreement.
4.9. The Seller is not responsible for the content and reliability of the information provided by the Buyer when placing the Order.
4.10. The Buyer is responsible for the accuracy of the information provided when placing the Order and purchasing the Product.
4.11. The Buyer pays for the Order with a debit/credit bank card. Payment is made by entering bank card details when placing an Order. The buyer confirms that the credit or debit card used for payment belongs to him/her. All fields marked as mandatory must be filled in. The corresponding amount will be credited from the Buyer's card if the transaction is successful. The seller is not responsible for the failure of the bank to carry out the transaction, in particular, in connection with the need to verify the transaction and/or the need to comply with any other legal requirements. Buyer bears all fees and any other amounts associated with payment in this manner. Payment for the Goods can be made in another way, determined and agreed by the Seller.
5. Terms of delivery of Goods
5.1. The Buyer chooses one of the methods of delivery of Goods, from the ones indicated on the Online Shop’s website, including international delivery.
5.2. The cost of the chosen method of delivery is calculated individually, based on the announced cost, which corresponds to the actual amount of the order according to the prices of the delivery service, and is paid by the Buyer.
5.3. The term and conditions of delivery are determined by the relevant service (including international) delivery, depending on the method of delivery chosen by the Buyer. The seller is not responsible for the terms and conditions of delivery and does not determine them.
5.4. The place of delivery of the Goods is indicated by the Buyer when placing the Order for the purchase of the Goods.
5.5. The term of delivery of the Goods to the Buyer consists the term of processing the order and the term of delivery.
5.6. The delivered Goods are handed over to the Buyer, and in the absence of the Buyer - to the person who presented the receipt or other document confirming the conclusion of the Agreement or registration of the delivery of the Goods, in accordance with the terms of the delivery service.
5.7. In cases stipulated by the current legislation of Ukraine, the cost of delivery, including international delivery, will not be reimbursed to the Buyer. This clause applies in case of return (exchange) of the Goods to the Buyer.
5.8. Delivery is carried out throughout the territory of Ukraine, with the exception of the temporarily occupied territories of Ukraine, as well as outside the borders of Ukraine.
5.9. International delivery of the Goods is carried out by the delivery services of UkrPoshta (https://www.ukrposhta.ua) to any country in the world. You can place an Order for the Product by e-mail: gepard.hunter.shoes@gmail.com.
5.10. The cost of the international delivery service is paid by the Buyer when placing the Order and purchasing the Product in accordance with the prices of the international delivery service.
5.11. The Buyer understands that in order to receive the Goods outside of Ukraine, there may be additional costs for customs clearance of the Goods, including additional filings and fees, etc., which the Buyer shall cover on his/her own.
5.12. Return and exchange of Goods, including refunds for Goods of inadequate quality, are carried out in accordance with the procedure established by Clause 5.7. and Section 6 of the Agreement. Duties, taxes and other mandatory fees are not refundable.
5.13. If the international delivery service returns the Goods to the Seller due to the Buyer's refusal to accept the Goods, the Seller has the right, in cases provided by law, to charge all delivery costs and the cost of the Goods from the Buyer in accordance with the procedure established by the current legislation of Ukraine and international treaties or the legislation of the country - delivery of goods.
6. Exchange and return of Goods
6.1. Unless another warranty period is indicated on the Product page (or in the settlement document or in the current legislation of Ukraine), the warranty period for any Product, determined by the Seller, is 14 (fourteen) days from the date of its receipt.
6.2. The Buyer has the right to exchange the Goods of proper quality for similar ones, if the Goods did not satisfy him/her in terms of shape, dimensions, style, color, size or for other reasons and cannot be used by him/her as intended. Such a right is retained by the Buyer for 14 days (or a longer period if the Goods were sent abroad), starting from the next day when the Goods were received by the Buyer, provided that:
• The product has not been used (including its use for photography or video recording) and has retained its commercial appearance.
• The product has not been washed and/or not subjected to chemical cleaning ("dry cleaning").
• The Product does not have any stains/ make-up foundation, etc.
• All labels, sticker, etc. are in place. All labels, stickers, tags must be unseparated (not torn or cut off) from the Product.
• In case of non-compliance with the above conditions, the Product is NOT subject to return/exchange. Such Goods will be sent back at the expense of the Buyer.
6.3. If there is no similar Product at the time of exchange, then the Buyer has the right to purchase a similar Product from the Seller or demand a refund from the Seller. In this case, the funds are returned to the Buyer within 7 days from the moment of receipt of the corresponding written demand from the Buyer. This term can be extended in cases where the Goods were sent abroad. The term of refund directly depends on the originating bank and the beneficiary bank .
6.4. All costs (in the cases provided by the legislation of Ukraine) related to the return/exchange of Goods of appropriate quality are borne by the Buyer (in particular, costs related to delivery).
6.5. Together with the Goods, the Buyer must send:
• The settlement document (cashier's check or its copy), which was previously sent to the Buyer's e-mail address or which was given to the Buyer, if the Goods were paid for after delivery and were received using a delivery service. Attention: a copy of the settlement document taken from the control tape, a police certificate, a bank statment, a JCC payment receipt, an SMS message about withdrawing funds, witness statements are not considered settlement documents.
• A completed and signed return application (included with the order or can be downloaded here);
• The returned goods, which must be in their original condition and must have no signs of use (there must be tags, labels, etc.);
When paying for an order through the Portmone system or any other payment system, the refund will be made to the same card that was used to pay for the Product. The exception is orders with payment for the Goods upon receipt and/or if the Buyer paid for the Goods on the basis of details provided by the Seller. In such case, the Buyer must provide full bank details to which the Seller will refund money for the Goods. Therefore, the Buyer must fill in the Application for Return: First and Last name, recipient, tax number and IBAN. The Buyer is responsible for providing the correct details.
6.6. If, during the procedure for returning the Goods, the Seller has established that the Buyer has not provided the necessary documents or data, the refund period will be extended until the Buyer provides the necessary information or documents.
6.7. The possibility of exchanging the Product for another non-similar product (different type, model, style, etc.) is not available for online purchases. However, the Buyer can always return the Product within the specified period and form a new order.
6.8. If within 14 (fourteen) days from the moment of receipt of the Product, a significant defect in the product (hidden defect or factory defect) was discovered, the Product is accepted by the Seller for repair or exchange, and if it is impossible to eliminate the defect/factory defect or the Buyer does not want to receive a similar goods, then the Seller will return the money.
6.9. In the case of discovering a significant defect in the Goods, the Buyer must notify the Seller either by email gepard.hunter.shoes@gmail.com or contact Seller by following phone number +38067 488 75 75. In such case, the Goods will be returned by the Nova Poshta delivery service, and all costs associated with the delivery of goods of inadequate quality will be borne by the Seller.
6.10. Return and exchange of goods is carried out throughout the territory of Ukraine, with the exception of temporarily occupied territories
6.11. The Buyer's claims shall not be satisfied if it is proven that the defects of the Goods arose as a result of the Buyer's violation of the rules for using the Goods, the terms of its storage or the terms of return.
6.12. The Seller has the right to refuse the Buyer the return of quality Goods, which, in accordance with Article 9 of the Law of Ukraine "On the Protection of Consumer Rights" and the Resolution of the Cabinet of Ministers of Ukraine "On the Implementation of Certain Provisions of the Law of Ukraine "On the Protection of Consumer Rights" No. 172 of March 19, 1992, is recognized as such, which is non-refundable.
7. Refunds
7.1. Funds are returned to the Buyer after receipt of the returned Goods, processing by the Seller of the duly completed application of the Buyer, the attached documents regarding the Goods and confirmation of the grounds for return.
7.2. Refunds are made by transfer to the Buyer's bank account or the number which was indicated in the return application, or other bank details from which the payment for the Goods was made - no later than 7 days from the moment of receipt by the Seller of the returned Goods, statements and confirmation of the Buyer's compliance with the terms of return Goods. This term can be extended in cases where the Goods were sent abroad. The term of refund directly depends on the originating bank and the beneficiary bank.
7.3. When returning funds to the Buyer's bank account, the term of receipt of funds to the Buyer's account may depend on the policy of the bank that issued the card.
8. Privacy Policy
8.1. The Buyer's personal data shall be processed by the Seller in accordance with the Law of Ukraine No. 2297-VI dated June 1, 2010 "On the Protection of Personal Data".
8.2. Personal data of Buyers is collected and processed by the Seller exclusively for the purpose of selling the Goods, proper implementation of the terms of the Agreement and compliance with the current legislation of Ukraine.
8.3. In order to ensure the implementation of relations regarding the purchase and sale of Goods on the website, the Buyer gives his/her consent to the Seller to transfer (distribute) his/her data to "NOVA POSHTA" LLC (YEDRPOU 31316718), to other delievery and courier organizations, including the services of international delivery and to any Banks and/or financial institutions at the discretion of the Seller.
8.4. The owner of the provided personal data is the Buyer, a sole proprietor Tetyana Mykolaivna Malikova. Location of the personal data storage "Buyers" is at 65000 Odesa, Fontanska doroga 71A, office 1100.
8.5. The Seller has the right to use "cookies" technology to monitor the activity of the website and the activity of Buyers on it.
8.6. "Cookies" files do not collect confidential information and are not transferred to third parties.
8.7. The Seller takes all possible and sufficient measures to preserve the personal data of Buyers, however, it cannot guarantee their absolute security, taking into account the peculiarities of conducting activities on the Internet.
